Definitions and Interpretation

In these Terms of Service, unless the context otherwise requires:

  • "Verification service" or "the Service" means the Kaharagian Document and Animal Verification service, accessible at verify.kaharagia.org, including all associated systems, interfaces, and lookup channels.
  • "Kaharagia" or "the State" means the Principality of Kaharagia, its sovereign institutions, and competent authorities acting under lawful mandate.
  • "User" means any natural or legal person who accesses or uses the Service.
  • "Record" means an entry in a Kaharagian official register (including, without limitation, document credentials and animal registrations) accessible through the Service.
  • "Record Holder" means the person to whom a Record relates or who is identified as the responsible party in the underlying register.
  • "Alias Token" means a privacy-preserving identifier issued by the Service for the purpose of enabling contact with a Record Holder without disclosing their contact details.
  • "Terms" means these Terms of Service, as amended from time to time.

Identity and Nature of the Service

The Verification service is the official public lookup tool of the Principality of Kaharagia. It allows any person, anywhere in the world, to confirm the authenticity and current status of a document, credential, or animal registration issued under Kaharagian authority.

The Service provides:

  • Direct lookup of Records by entering a reference number, scanning a QR code, or following a published verification link
  • Confirmation of authenticity, current validity, and (where applicable) status of the relevant Record
  • A privacy-preserving contact channel allowing Users to reach the Record Holder via an Alias Token, without disclosure of the Record Holder's contact details
  • A general contact channel for enquiries to the State

The Service exists to confirm the authenticity of records issued by the State. It does not, in itself, issue documents, credentials, or registrations, and confirmation of authenticity through the Service is not equivalent to a legal opinion or formal certification.

By accessing or using the Service, you acknowledge that you have read, understood, and accept these Terms in their entirety.

If you do not agree to these Terms, you must immediately cease all use of the Service.

Privacy Invariant: Verification Without Identification

A defining principle of the Service is that it is designed to verify the record, not identify the holder. A successful verification confirms that a Record exists, is authentic, and (where applicable) is currently valid, but it does not disclose the Record Holder's contact details, address, or other personal information beyond what is strictly necessary to make the verification meaningful.

Where contact with a Record Holder is appropriate (for example, a finder of a lost document, or a person who has located a registered animal), the Service provides an Alias Token-based contact channel. Messages sent through this channel are routed through the Service; the Record Holder may choose whether to respond, and the User does not learn the Record Holder's identity or contact details unless the Record Holder voluntarily provides them in their reply.

Governing Law, Sovereignty, and Jurisdiction

Applicable Law

These Terms, the Service, and all matters arising from or relating to their interpretation, application, or use are governed exclusively and in all respects by the laws of the Principality of Kaharagia.

No foreign law, legal principle, or regulatory framework applies to these Terms or the Service unless expressly and formally incorporated into Kaharagian law by competent sovereign authority.

The Service is technically hosted on infrastructure located in the Federal Republic of Germany, and the associated domain name is registered through a registrar situated in the Federal Republic of Germany. These technical and administrative arrangements:

  • Do not constitute consent, submission, or subjection to German, European Union, or any other foreign jurisdiction;
  • Do not create, confer, or imply any enforceable rights, claims, or causes of action under foreign law;
  • Do not alter, diminish, or qualify the sovereign legal order of Kaharagia or its exclusive jurisdiction over the Service.

Eligibility and Access

The Service is open to the public and may be used without registration or authentication. Use is voluntary and does not establish any contractual or administrative relationship with the State.

Permitted Use and Prohibited Conduct

Scope of Permitted Use

The Service may be used to verify the authenticity of documents, credentials, or animal registrations to which the User has lawful access, and to contact a Record Holder through the Alias Token channel for legitimate purposes consistent with the nature of the Record.

Prohibited Conduct

Users shall not, whether directly, indirectly, or through any agent, device, or automated means:

  • Use the Service to harvest, enumerate, or systematically scrape Records or reference numbers;
  • Use the Alias Token contact channel to harass, stalk, defame, threaten, or solicit any Record Holder;
  • Attempt to identify a Record Holder through indirect means, correlation attacks, or unauthorised aggregation of Service data;
  • Submit fraudulent, malicious, or misleading content through any channel of the Service;
  • Use the Service in a manner that imposes disproportionate load on its systems or interferes with its availability;
  • Attempt unauthorised access to any system, function, or data not exposed for ordinary public use;
  • Misrepresent the result of a verification, including by altering or fabricating screenshots or output of the Service;
  • Use the Service for any purpose unlawful under Kaharagian law or the law of the User's jurisdiction.

The privacy invariant of the Service is treated as a matter of public trust. Conduct designed to circumvent it may constitute an offence under Kaharagian law and may be referred for appropriate action.

Verification Outcomes and Their Limits

A positive verification result indicates that the Record exists in the relevant Kaharagian register and is, at the moment of the lookup, authentic and (where applicable) valid. It does not by itself constitute:

  • A legal opinion as to the substantive validity, scope, or effect of the Record under any law;
  • A certification of identity, qualification, or status of any person beyond the contents of the Record;
  • A guarantee of any fact not specifically returned in the verification output.

A negative verification result, the absence of a Record, or an error returned by the Service should not be relied upon as conclusive proof that a Record does not exist or is not valid; technical issues, transient unavailability, or data-entry errors may produce such outcomes.

Security Measures and Residual Risk

The State implements reasonable, proportionate technical and organisational security measures designed to protect the Service. Such measures include access controls, encryption in transit, monitoring and logging, and procedural safeguards.

No digital system can be guaranteed to be absolutely secure. Users acknowledge that residual risk is inherent in all digital services.

Data Protection and Privacy

The processing of personal data through the Service is governed by Kaharagian data protection law and by the Verification Privacy Notice, which forms an integral part of these Terms.

Disclaimer of Warranties

The Service is provided strictly on an "as is" and "as available" basis, without warranty of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by Kaharagian law, the State disclaims all warranties of availability, uptime, reliability, accuracy, completeness, or fitness for any particular purpose.

Limitation of Liability

To the fullest extent permitted by Kaharagian law:

  • The Kaharagian State, its institutions, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to the Service;
  • No liability shall arise from the consequences of relying or not relying upon a verification result;
  • No liability shall arise from system downtime, maintenance, delay, or service interruption;
  • No liability shall arise from the conduct of any other User of the Service.

Nothing in these Terms shall be construed to exclude or limit liability where such exclusion or limitation is expressly prohibited by sovereign law.

Suspension, Restriction, and Termination

Access to the Service may be suspended, restricted, or terminated, in whole or in part, at any time and without prior notice, for breach or suspected breach of these Terms, for security or operational reasons, or by administrative decision.

Where conduct prohibited by these Terms is detected, the State may take protective measures including but not limited to rate limiting, IP blocking, and referral to law enforcement.

Institutional Authority and Non-Waiver

Nothing in these Terms shall be construed to limit, constrain, or fetter the sovereign authority of the Principality of Kaharagia or the discretion of competent authorities. The failure or delay by the State to enforce any provision shall not constitute a waiver.

Effect of Correspondence

Submission of correspondence does not create any obligation to respond, acknowledge, or act upon the correspondence. Only communications formally issued through official channels and bearing appropriate authentication shall have legal effect.

Amendment and Revision

These Terms may be amended at any time by the State without prior notice. Continued use of the Service following publication constitutes acceptance.

Severability

If any provision of these Terms is held to be invalid or unenforceable under Kaharagian law, such provision shall be severed to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with the Verification Privacy Notice and any other documents expressly incorporated by reference, constitute the complete and exclusive legal framework governing access to and use of the Service.
