Shop Terms of Sale
Definitions and Interpretation
In these Terms of Sale, unless the context otherwise requires:
- "Shop" or "the Service" means the Kaharagia Official Shop at shop.kaharagia.org, including its catalogue, checkout, fulfilment, and administrative interfaces.
- "Kaharagia" or "the State" means the Principality of Kaharagia, its sovereign institutions, and competent authorities acting under lawful mandate.
- "Customer" means any natural or legal person who places an order through the Shop.
- "Order" means a request to purchase goods through the Shop, accepted in accordance with these Terms.
- "Stripe" means Stripe Payments Europe, Limited and its affiliates, the payment processor used by the Shop.
- "Terms" means these Terms of Sale, as amended from time to time.
Identity and Nature of the Service
The Shop is the official commercial outlet of the Principality of Kaharagia for the sale of state-related items, including ceremonial goods, regalia accessories, publications, and other authorised merchandise.
The Shop is operated under sovereign authority. Sales through the Shop constitute a commercial transaction between the Customer and the State, governed by these Terms and by Kaharagian law.
Acceptance of Terms
By placing an Order through the Shop, the Customer acknowledges that they have read, understood, and accept these Terms in their entirety, together with the Shop Privacy Notice.
If the Customer does not agree to these Terms, they should not place an Order.
Eligibility to Purchase
Orders may be placed by any natural person of legal capacity, or by any legal entity duly constituted under the law of its jurisdiction. Customers must provide accurate name, contact, and shipping information at checkout.
The State reserves the right to refuse any Order, including without limitation Orders that appear fraudulent, that originate from jurisdictions to which export is restricted, or that the State, in its sole discretion, considers inappropriate.
Catalogue, Pricing, and Currency
Prices, descriptions, and availability of goods are as displayed on the Shop at the time of Order. The State endeavours to keep these accurate but does not guarantee completeness or freedom from error. In the event of an obvious pricing or description error, the State may correct the error and, where appropriate, cancel or refund the affected Order.
Prices are displayed in the currencies offered at checkout. The currency charged is the currency selected at checkout; foreign-exchange or card-network conversion costs imposed by the Customer's bank or card issuer are the responsibility of the Customer.
Payment
Payment is processed by Stripe, an independent third-party payment processor, and is subject to Stripe's terms of service and privacy policy. The Customer's payment-card details are submitted directly to Stripe and are not received or stored by the State, save for tokens, last-four digits, and transaction identifiers necessary for order management and refund processing.
By placing an Order, the Customer authorises the charge to be made to the payment method provided.
Acceptance of Order and Formation of Contract
Display of goods on the Shop is an invitation to treat, not an offer. The Customer's submission of an Order constitutes an offer to purchase. A binding contract of sale is formed only when the State accepts the Order, which acceptance is signified by dispatch of the goods or by formal confirmation of acceptance, whichever is earlier.
The State may decline to accept an Order in whole or in part for any lawful reason. Where an Order is declined after payment has been taken, payment shall be refunded in full.
Shipping and Delivery
Shipping Methods and Carriers
Goods are shipped via the carriers offered at checkout. Available shipping methods, carriers, and estimated delivery times are displayed at checkout and depend on the destination.
Shipping Address
The Customer is responsible for providing an accurate and complete shipping address. The State accepts no liability for non-delivery, delay, or loss arising from an inaccurate or incomplete address provided by the Customer.
Risk of Loss
Risk of loss in the goods passes to the Customer upon dispatch from the State's fulfilment facility.
International Shipping, Customs, and Duties
Where goods are shipped outside the Principality of Kaharagia or its territorial domains, the Customer is responsible for any import duties, taxes, customs clearance fees, and other charges imposed by the destination jurisdiction. The State does not undertake to act as importer of record and does not provide customs brokerage.
The State accepts no responsibility for goods seized, returned, or destroyed by customs authorities of any jurisdiction.
Delivery Times
Estimated delivery times are indicative only and do not constitute a contractual commitment. Delays caused by carriers, customs, force majeure, or other factors outside the State's control are not the responsibility of the State.
Returns, Refunds, and Cancellations
Cancellation Before Dispatch
The Customer may cancel an Order at no charge at any time before the goods have been dispatched, by contacting the Shop through the published support channel.
Returns After Dispatch
Returns may be accepted within fourteen (14) days of receipt, provided the goods are returned in unused, resalable condition with original packaging. The Customer is responsible for return shipping costs unless the return is by reason of a defect, mistake, or non-conformity attributable to the State.
Non-Returnable Goods
The following goods are not returnable except in the case of defect attributable to the State:
- Personalised, custom-made, or made-to-order items
- Perishable goods
- Sealed goods unsealed after delivery for hygiene or safety reasons
- Digital downloads after delivery
Refunds
Refunds for accepted returns are made to the original payment method via Stripe. Processing time depends on Stripe and the Customer's bank, and is typically several business days.
Defective or Non-Conforming Goods
If goods are defective, damaged in transit, or do not conform to their description, the Customer should report this within a reasonable time after receipt. The State will, at its election, replace the goods, repair them, or refund the Customer.
Governing Law and Jurisdiction
These Terms, the Shop, and any Order placed through the Shop are governed exclusively by the laws of the Principality of Kaharagia. Disputes are subject to Kaharagian law and the procedural rules of the Principality.
The technical hosting of the Shop in the Federal Republic of Germany, the use of Stripe (a payment processor based in the Republic of Ireland with operations across multiple jurisdictions), and the fulfilment of Orders to addresses outside Kaharagia do not constitute consent or submission to the jurisdiction of any of those jurisdictions.
Permitted Use and Prohibited Conduct
Customers shall not:
- Submit fraudulent payment information or attempt unauthorised use of payment methods
- Place Orders for resale on a commercial scale without prior written authorisation from the State
- Misrepresent the contents of an Order, the destination, or the purpose of import
- Interfere with or disrupt the operation of the Shop
- Use the Shop for any purpose unlawful under Kaharagian law or the law of the destination jurisdiction
- Misuse the appearance of state insignia, regalia, or official marks acquired through the Shop in a manner inconsistent with the Crown Copyright policy
Service Availability and Limitation of Liability
The Shop is provided on an "as is" and "as available" basis. The State does not warrant uninterrupted operation, freedom from error, or that goods will meet any particular requirement beyond their published description.
To the fullest extent permitted by Kaharagian law, the State's liability arising from any Order is limited to the price paid by the Customer for the goods that are the subject of the claim. The State shall not be liable for any indirect, incidental, consequential, special, or punitive damages.
Nothing in these Terms shall exclude or limit liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be excluded under applicable law.
Suspension and Termination
The State may suspend or terminate access to the Shop, refuse Orders, or cancel pending Orders at any time, including for breach or suspected breach of these Terms or for security or operational reasons.
Force Majeure
The State shall not be liable for any failure or delay in performance arising from circumstances outside its reasonable control, including without limitation acts of state, war, civil unrest, natural disaster, pandemic, carrier failure, or interruption of payment processing.

Amendment and Revision
These Terms may be amended at any time. The version of the Terms in force at the time an Order is placed governs that Order.
Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect.
Entire Agreement
These Terms, together with the Shop Privacy Notice, the published catalogue, and the order confirmation issued at the time of acceptance, constitute the complete legal framework governing each Order.
