Káhareži Fondazár (the "Foundation," "we," "us," or "our") supports the Kaharagian language, culture, and educational outreach.
Relationship to the Principality of Kaharagia
The Foundation is a separate legal person from the Principality of Kaharagia. The Foundation is incorporated under United States law (Michigan); the Principality is a self-declared sovereign entity governed by Kaharagian law. Donations to the Foundation, Foundation programmes, and Foundation governance are matters of US/Michigan charitable law and IRS regulation, not of Kaharagian law.
References on Foundation websites to Kaharagian culture, decorations, programmes, or institutions reflect the cultural and educational mission of the Foundation; they do not establish that the Foundation is a Kaharagian state institution or that the Principality is a party to any Foundation transaction.
Scope of These Terms
These Terms govern your access to and use of:

Acceptance
By accessing or using fondazar.org, you agree to these Terms and to the Káhareži Fondazár Privacy Notice. If you do not agree, please do not use the site.
Donations
How Donations Are Processed
Donations to the Foundation are processed by Stripe Payments Company ("Stripe") on the Foundation's behalf. Card details are submitted directly to Stripe and are not received or stored by the Foundation, except for tokens, the last four digits of the card, and transaction identifiers necessary for receipts and accounting.
Tax Deductibility
The Foundation is a US 501(c)(3) public charity. Donations are tax-deductible to the extent permitted by US federal law and by the donor's state law. The Foundation does not provide tax advice; donors should consult a qualified tax advisor for specific guidance on deductibility.
For donations of $250 or more, donors will receive a written acknowledgement satisfying the substantiation requirements of IRC §170(f)(8). For donations of any amount, donors may request a written acknowledgement.
No Quid Pro Quo Without Disclosure
Where a donation is made in exchange for goods or services with a fair market value, the deductible portion of the donation is the amount in excess of that value. Such transactions, where they occur, will be clearly disclosed at the time of donation.
Refunds of Donations
Donations are generally not refundable, except in cases of clear processing error or as required by Stripe's chargeback procedures or by applicable law. Requests to refund a donation should be made promptly to the Foundation through the contact channel below.
Use of the Site
Permitted Use
You may read, share links to, cite, and quote the Foundation's content for personal, educational, journalistic, and research purposes, with appropriate attribution.
Prohibited Conduct
You agree not to:
- Submit fraudulent payment information or attempt unauthorised use of payment methods;
- Impersonate the Foundation or any of its officers;
- Misrepresent the Foundation's tax status, EIN, or governance;
- Use the Foundation's name, logo, or mark in a manner suggesting endorsement of unrelated activities, persons, or organisations;
- Interfere with or disrupt the operation of the site;
- Use the site for any purpose unlawful under US, Michigan, or applicable foreign law.
Intellectual Property
Content on fondazar.org is © Káhareži Fondazár or its licensors, except where otherwise indicated. The Foundation grants you a limited, non-exclusive licence to use site content for personal, educational, and journalistic purposes with attribution to "Káhareži Fondazár (KAHARAZI VONDACIJA)."
The Foundation's name, logo, and visual identity may not be used in any manner suggesting endorsement of, or affiliation with, products, services, organisations, or political positions without the Foundation's prior written permission.
The Foundation reproduces certain Kaharagian cultural and state imagery (including arms, decorations, and other symbols) under the cultural-mission license arranged with the Royal Chancellery of the Principality of Kaharagia. This reproduction does not transfer ownership of those symbols, which remain governed by Kaharagian Crown Copyright. Third parties wishing to use such symbols should contact the Royal Chancellery directly.
No Endorsement of External Content
The site may link to external websites and resources not operated by the Foundation. Such links are provided for convenience and do not imply endorsement. The Foundation accepts no responsibility for the content, privacy practices, or availability of third-party sites.
Site Availability and Disclaimer
The site is provided "AS IS" AND "AS AVAILABLE." The Foundation makes no warranties, express or implied, and to the fullest extent permitted by law disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.
The Foundation does not warrant that the site will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
Limitation of Liability
To the fullest extent permitted by US law and the law of the State of Michigan, in no event will the Foundation, its directors, officers, employees, or volunteers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your access to or use of the site, or any donation made through the site.
The Foundation's total aggregate liability arising out of or relating to these Terms or the site shall not exceed one hundred United States dollars ($100), or, in the case of a donation made through the site, the amount of that donation.
Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or for any liability that cannot be excluded under applicable law.
Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless the Foundation, its directors, officers, employees, and volunteers from any claim or demand arising out of your breach of these Terms or your use of the site in violation of applicable law.
Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Michigan, USA, and the United States, without regard to conflict-of-laws principles. Disputes arising from these Terms or from use of the site shall be brought in the state or federal courts located in Wayne County, Michigan, and you consent to the personal jurisdiction of those courts.
The above choice of forum is for the convenience of the Foundation and does not deprive you of the protection of any consumer-protection law that, by its terms, applies to you and cannot be derogated from by agreement.
Children Under 13
The site is not directed at children under the age of 13. The Foundation does not knowingly collect personal information from children under 13 in violation of the US Children's Online Privacy Protection Act ("COPPA"). If you believe a child under 13 has provided information through the site, please contact us so we can delete it.
Changes to These Terms
The Foundation may revise these Terms from time to time. The "Last Reviewed" date indicates when the Terms were most recently updated. Continued use of the site after changes are posted constitutes acceptance of the revised Terms.
