Design System Terms of Service
Definitions and Interpretation
In these Terms of Service, unless the context otherwise requires:
- "Design System" or "the Service" means the Kaharagian Design System reference at design.kaharagia.org, including its component documentation, design tokens, fonts, downloadable assets, and demonstration widgets.
- "Kaharagia" or "the State" means the Principality of Kaharagia, its sovereign institutions, and competent authorities acting under lawful mandate.
- "User" means any natural or legal person who accesses or uses the Service.
- "Asset" means any file (including but not limited to fonts, icons, logos, arms, seals, badges, colours, and component code) made available through the Service, whether by inspection, copy-paste, or download.
- "Royal Symbols" means the arms, flags, badges, seals, decorations, and other state insignia of the Principality of Kaharagia.
- "Terms" means these Terms of Service, as amended from time to time.
Identity and Nature of the Service
The Design System publishes the visual identity, design tokens, and front-end conventions used across Kaharagian digital services. It exists to:
- Document the visual standards of Kaharagian digital services for the benefit of designers, developers, and contractors;
- Make non-restricted Assets (such as design tokens, components, and ordinary illustration) available for reuse in conformant work;
- Catalogue Royal Symbols for reference, with their licensing status clearly indicated.
The Service is informational and reference in nature. It is not a transactional service.
Acceptance of Terms
By accessing the Service, downloading any Asset, or copying any token, code snippet, or markup from the Service, you acknowledge that you have read, understood, and accept these Terms in their entirety and the Crown Copyright policy.
Asset Licensing. Three Categories
Assets on the Service fall into three licensing categories, which are indicated on the relevant page or component.
1. Open for Reuse
Design tokens, component markup, ordinary illustration, and similar non-state-symbolic Assets may be reused in any work, subject to the Crown Copyright policy. Attribution is appreciated but not required for ordinary technical reuse.
2. Reuse with Conformance
Some Assets, including official iconography, certain typefaces, and particular component patterns, may be reused only in work that is consistent with the visual identity of the Principality and that does not misrepresent affiliation, status, or endorsement. The State reserves the right to require corrective action where such Assets are used in a manner inconsistent with this restriction.
3. Restricted (Royal Symbols and State Insignia)
Royal Symbols may not be reproduced, displayed, or used without express written permission from the Royal Chancellery. This restriction applies regardless of the technical accessibility of an Asset on the Service. Inclusion of a Royal Symbol in the Service for reference or documentation purposes does not constitute a licence to use it.
This category includes, without limitation: the Kaharagian coat of arms, the Royal arms, royal monograms and ciphers, official seals, the flags of the Principality and of Royal House and Office, badges of the Orders of Honour, decorations, medals, and any composite or stylised reproduction of any of the foregoing.
Acceptance of Terms
By downloading or otherwise extracting any Asset from the Service, the User warrants that they have read these Terms, identified the licensing category of the Asset, and will use the Asset only in accordance with that category and with the Crown Copyright policy.
Governing Law, Sovereignty, and Jurisdiction
Applicable Law
These Terms, the Service, and all matters arising from or relating to their interpretation, application, or use are governed exclusively and in all respects by the laws of the Principality of Kaharagia.
Technical Hosting and Foreign Legal Assertions
The Service is technically hosted on infrastructure located in the Federal Republic of Germany, and the associated domain name is registered through a registrar situated in the Federal Republic of Germany. These arrangements do not constitute consent or submission to any foreign jurisdiction.
Permitted Use and Prohibited Conduct
Permitted Use
The Service may be read, browsed, and (subject to the licensing categories above) Assets may be reused in conformant work.
Prohibited Conduct
Users shall not:
- Reproduce, display, or use any Royal Symbol or other Restricted Asset without express written permission from the Royal Chancellery;
- Use any Asset in a manner that misrepresents affiliation with, endorsement by, or official status of the Principality of Kaharagia;
- Reproduce Assets in a manner that brings the Principality into disrepute or that is otherwise inconsistent with the dignity of the State;
- Use Assets in connection with goods or services contrary to Kaharagian law;
- Use automated systems to scrape the Service at scale without authorisation;
- Interfere with the operation, integrity, or availability of the Service.
Misuse of Royal Symbols may constitute an offence under Kaharagian law and may be referred for appropriate action.
Trademark and Trade-Dress
The visual identity of the Principality of Kaharagia, including Royal Symbols, the typographic conventions, the colour palette and gold accent, and the composite design language documented on the Service, are protected as a matter of Kaharagian law and applicable international principles.
Use of these elements in a manner likely to cause confusion as to source, affiliation, or endorsement is prohibited.
Service Availability and Limitation of Liability
The Service is provided on an "as is" and "as available" basis, without warranty of fitness for a particular purpose. Assets are provided as reference material; the State does not warrant that any Asset is suitable for any specific technical or design context.
To the fullest extent permitted by Kaharagian law, the State shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from use of the Service or any Asset.
Data Protection and Privacy
The processing of personal data through the Service is governed by Kaharagian data protection law and by the Design System Privacy Notice.
Institutional Authority and Non-Waiver
Nothing in these Terms shall be construed to limit, constrain, or fetter the sovereign authority of the Principality of Kaharagia, or the prerogative of the Crown over Royal Symbols.
